Divorce Certificate

Before approaching your local authority, ensure you have the following paperwork ready:

  • The Legal Foundation: The original written Talaq Nama (executed on standard stamp paper) OR a certified copy of the Khula Decree from the Family Court.
  • Marriage Record: A copy of the original Nikah Nama or a NADRA Marriage Registration Certificate.
  • Identity Documents: Clear photocopies of the CNICs of both spouses, along with photocopies of their fathers’ CNICs.
  • Witnesses: CNIC copies of two male witnesses to the divorce proceedings.

2. The Official Step-by-Step Procedure

The entire legal lifecycle takes approximately 90 to 120 days due to statutory waiting periods defined under Section 7 of the Muslim Family Laws Ordinance, 1961.

1.File Notice with the Union Council:Within 30 days of pronouncement.

Submit a formal written notice of the divorce along with your supporting documents to the Union Council. Jurisdiction is critical: By law, this must be filed at the Union Council corresponding to where the wife is currently residing. A copy of this exact notice must also be sent to the wife via registered mail.

2.Arbitration & Reconciliation Notices:30-day window.

Upon receiving the notice, the Chairman of the Union Council forms an Arbitration Council. Over the next few weeks, the council will issue three separate official notices to both parties, summoning them to attend reconciliation meetings to try and save the marriage. Both parties can appear in person or through designated representatives.

3.The 90-Day Waiting Period:Mandatory cooling-off.

If reconciliation attempts fail or if one party consistently refuses to show up after the notices, a mandatory 90-day waiting period (Iddat) begins. This timeline is calculated strictly from the date the initial notice was officially received and logged by the Union Council Chairman.

4.Issuance of the Computerized Certificate:Finalization.

Once the 90 days lapse without any reconciliation or formal revocation of the divorce, the Union Council closes the case. The operator logs the closure into the database, generating the official computerized NADRA Divorce Certificate with a unique tracking QR code.

3. The Crucial Next Step: Updating National Records

Once you receive the physical certificate from the Union Council, the process is still only halfway done. Both individuals must manually update their personal status in the national identity system.

  • NADRA Database Update: Take the computerized certificate to your nearest NADRA Registration Center (NRC) or apply via the PakID Mobile App.
  • System Impact: This changes your official marital status to “Divorced,” allows you to modify your physical CNIC/NICOP, and permanently detaches the spouse linkage from your Family Registration Certificate (FRC).

⚠️ Important Note for Overseas Pakistanis: If you reside abroad, you can execute this entire process remotely. You must draft a specialized Power of Attorney (PoA) authorizing a representative or lawyer in Pakistan to manage the Union Council steps. This PoA must be attested by the Pakistani Embassy/Consulate in your country of residence and counter-attested by MOFA in Pakistan before it can be submitted to the UC.
